I. Registration

1. With registration the user bindingly accepts these terms of use.
2. Every user may only register one account.
3. The user is not eligible for participance. The developer of the game reserve the right to delete accounts, especially in case of offences against these terms of use and the following responsibilities of the user.
4. Providing wrong information at registration may lead to loss of the account.
5. Ingame every user has the option to delete his account. If a user does not use his account for 7 days, the account is automatically deleted by the server due to inactivity. The inactivity times may change, so please regard the concering information in the ingame overview.
6. Inactivity script: If a user does not log into his account for seven days, according to the game rules the game account will be deleted or transferred to sector 1.
7. Manipulative intrusion: The player is not authorized to use software or methods that attempts to disturb or manipulate the functions of this website or the game play. The user ist not allowed to use methods or software that overloads the technical capacity of the game servers or to produce inappropriate load. The player is not allowed to change, to block or to manipulate contents that are generated from the game provider or to disturb the game play in any way.
8. Unauthorized third party software: The player may not use any third party software to fetch or to access the game pages except a standard internet browser or the official Die Ewigen Browser (only in german). Especially so called "bots" or other tools that manipulate, change or extend the webinterface or functions of the game or it´s handling. The player may not use functions that automatically reload the pages of the game (e.g. the autorefresh in opera). The player is not allowed to suppress ads / banner of any kind. It is immaterial in what form this will happen or what software is used to suppress these elements of the game pages.

II. Data protection and data safety

1. The user agrees that his ip address is logged.
2. The information the user provides when registering will never be given to third parties.
3. Only the DET and the game support is able to access the data a user provides.
4. The user further accepts the responsibility to read ingame messages that have been sent by the DET or the support.
5. If a user decides to delete his account, all data of this user will be completely deleted from the game system.
6. Changing user information is only possible by the DET or the technical support.
7. The user agrees that his e-mail address is stored and used for information purposes (newsletter of Die Ewigen). Under no circumstances the e-mail address will be available to third parties. By request the e-mail address will be deleted from the mailing list.

III. Change of terms of use and rules

1. The DET reserves the right to change / extend the terms of use and is not responsible to inform every user. Changes of the terms of use or the rules are always accessable on our information page or in our board
2. Every user is responisble to read possible changes of the terms of use on the information page or our board.
3. If a user does not agree to changes of the terms of use, he must delete his account in order to end the agreement. Any further use of the account is regarded as an agreement to any changes of the terms of use.

IV. Responsibility of Content

1. The developer decline any responsibility for the content of the communication between players and for any content / texts / images a player brings into the game.
2. Personal information may not be published without the agreement of the affected person. This applies to IRC Channels, the board and in the game itself.
3. Racistic, pornographic, abusive, denunciatory and illegal comments / contents will immediately lead to account deletion and / or ban from the irc channel.

V. Responsibilities of the user

1. Only one account per server and per user is allowed.
2. It ist not allowed to take care for the accounts of other players (account sitting).
3. Every user must register his account on his own, it is not allowed to register accounts for other players.
4. The e-mail address that is used for registration must belong to the person that registers the account. E-Mail addresses that are used as shared mailboxes are not allowed for registration purpose.
5. It is not allowed to log into accounts of other players (account sharing).
6. If more than one person plays from the same ip address (shared internet access) the game support has to be informed.
7. Usage of anonymous proxies or other proxies is forbidden.
8. It is not allowed to transfer, sell, give away or to confer an account.
9. Every user is responsible for the safety of his password and that no one gains knowledge of this password. Password sharing is forbidden
10. It is forbidden to give away collectors when an account deletion is planned. It is forbidden to steal collectors with the agreement of the attacked player. This so-called "farming" may lead to the loss of the account.
11. It is forbidden to give away sector artifacts to other players (base commanders). It is forbidden to steal sector artifacts with the agreement of the attacked sector (base commander). This so-called "farming" may lead to the loss of the account.
12. Every player commits to play active and self-interested. If an account is used to bring other players forward, all accounts concerning this issue will be deleted (farming, pushing).
13. Bug exploiting is forbidden. If a bug / malfunction happens, the user is responsible to inform the game support or to leave a bug message in our board.
14. Usage of scripts or programs (bots etc.) for account management / automatical play is forbidden. Only the official DE Browser is allowed as additional tool. Automatical refreshing of pages (e.g. with the integrated refresh function of the opera browser) is forbidden.
15. It is forbidden to advertise external websites / products / services of any kind in the game.
16. It is forbidden to coerce, to convince or to demand other players to delete their accounts, to stop playing or to leave their sectors.
17. The user commits to inform the DET immediately if he gains knowledge of offenses of any kind against these terms of use.
18. The provider is authorized to move accounts or to withdraw bought advantages or ingame goods in unintentional situations that prevent a proper game play.
19. It is forbidden to rightlessly pretend to be staff member or team member of Die Ewigen.
20. The game provider is authorized to set the players account into vacation mode in the case of a excessive usage of the game to avoid health threats like short of sleep.
21. If a player disregards the board rules, the game provider reserves the right to lock the account of this player (main account).
22. It is not allowed to invite teammates to breach the rules.
23. When gaining knowledge about disregards of the responsibilities of the user, the game provider is authorized to lock or to delete the corresponding account. The game provider is authorized to delete player accounts without giving reasons.

The DET is authorised to suspend / delete accounts of users that disregard the terms of use. Further the DET is authorised to delete accounts without stating the reasons.

VI. Credits/Creditgewinne

1. Credit winnings are refunded to the game account where they have been won, not to the main account.
2. Credits can be transfered from the main account to the ingame accounts. The opposite direction is not possible.
3. Credits can not be transfered between main accounts.
4. Play time tickets can not be exchanged into credits.

VII. Copy right

1. All graphics, images, html-codes, source codes and texts (except content that belongs to the users of this game like avatars, sector images, user logos etc.) shown and used ingame or on other pages of Die Ewigen are copyrighted by Die Ewigen and their creators. Any violation of this copyright will have legal consequences.
2. All rights are reserved and stay under the ownership of the DET.
3. In areas where the user has the possibility to enter own content and own material, if the rights of third parties are violated, only the user is responsible. The crerators of Die Ewigen are not responsible for these user editable areas. If Die Ewigen discovers some kind of rights violation, the concering content will be deleted immediately. This also concerns to trade marks used as alliance name / nickname or short tag.

VIII. Disclaimer

1. Die Ewigen reserves the right not to be responsible for the topicality, correctness, completeness or quality of the information provided. Liability claims regarding damage caused by the use of any information provided, including any kind of information which is incomplete or incorrect, will therefore be rejected. Die Ewigen is not responsible for any damages incurred by use or failure to use information offered. All offers are not-binding and without obligation. Parts of the pages or the complete publication including all offers and information might be extended, changed or partly or completely deleted by Die Ewigen without separate announcement.

IX. References and Links.

In relation to direct or indirect references to other websites ("links") which are not within the area of responsibility of Die Ewigen, the latter company would only be under obligation to assume liability if it had knowledge of the content and if it had the technical ability and could be reasonably expected to prevent use in the event of there being illegal content.
